(AP) -- The only member of a Lenawee based militia group to plead guilty before trial has been released from jail in a new deal with federal prosecutors in Detroit.

Joshua Clough was facing a mandatory five years in prison for a gun crime.

But the government raised no objection Wednesday when Clough's lawyer asked a judge to throw out a December plea deal and allow him to take responsibility for a lesser gun offense.

The development is a direct result of the acquittal last week of seven Hutaree members who were charged with conspiring to wage war on the United States.

Clough of Lenawee County likely faces no additional time behind bars when he's sentenced Aug. 8.

Defense lawyer Randall Roberts is praising prosecutors for agreeing to the new deal.
