Driver pleads not guilty in drunken hayride crash

SANDUSKY -- A Sandusky man has pleaded not guilty to driving a tractor drunk while pulling a hayride.   Michael Hermes appeared in court Tuesday morning.

Police say he was driving the tractor last Saturday when a trailer carrying about 30 people on a hayride overturned. 28 people were hurt.

Investigators say they found open alcohol containers at the scene of the crash.  Hermes refused to take a breath test.

He is charged with aggravated vehicular assault, refusing to take a breath-alcohol test, having an open container and failure to control.

Some of those injured saturday night suffered broken bones while others were just shaken up.

The driver's attorney says the Hermes family is thinking about the victims and praying for their families.
