Toledo killer denied release, new trial

TOLEDO -- A Toledoan on death row for murdering a woman in 1997 has lost his bid for release or a new trial.

A federal appeals court denied Douglas Coley's request.   Coley was convicted of killing 21-year-old Samar El-Okdi.

He argued that his trial attorneys were ineffective and prosecutors were guilty of misconduct for using inconsistent theories about whether Coley or a co-defendant was the shooter.

The ruling says it doesn't matter whether Coley was the shooter since jurors found he caused the death through prior calculation or design.

Coley's attorney says they will ask for another ruling or appeal to the U.S. Supreme Court.
