Toledo homeowner who shot intruder protected by Ohio law

TOLEDO -- Police say Ohio state law is on the side of a North Toledo homeowner who shot an intruder early Saturday.

According to the court affidavit, the family of three was sleeping in their home on Hoops Drive when the suspect, 49-year-old Victor Stubblefield, broke in with a crowbar and screwdriver.

The male homeowner confronted the intruder and shot him twice in the arm and chest with a pistol. Sgt. Joe Heffernan said the homeowner will not be charged because he felt threatened and was well within his right to use force to protect his family.

The Defense of Habitation Law allows a homeowner to protect himself on his own property if someone has commited a criminal act.

"After the suspect went down, he did the right thing: He stopped. He held the intruder at gunpoint and turned the situation over to the police when they arrived." Sgt. Heffernan said.

Stubblefield was transported to Mercy St. Vincent Medical Center and is currently listed in fair condition. Sgt. Heffernan said he will be charged with aggravated burglary after his release.
