Toledoans will not cash in on Katrina imprisonment

NEW ORLEANS -- It appears, two Toledo men imprisoned for a month in New Orleans in the aftermath of hurricane Katrina will not be getting a huge payday after all.

A federal appeals court has thrown out a jury's award for more than $650,000 to Paul Kunkel and Robie Wagenfeald.

They spent about a month in custody after being arrested for disorderly conduct two days before Katrina hit in August 2005.

The judges ruled new orleans didn't falsey imprison them because some rules were suspended because of the killer storm.
