TOLEDO, OH -- Two former Lucas County Sheriff's deputies found guilty in the death of an inmate at the Lucas County jail filed notices of appeal with the U.S. District Court.
Retired sergeant John Gray and retired Deputy Jay M. Schmeltz filed their intent to appeal the guilty verdict Wednesday.
Gray was found guilty of violating the civil rights of jail inmate Carlton Benton who died while in custody at the jail. Gray reportedly left Benton unconscious in a cell without seeking medical attention for him. He was also convicted on two counts of writing a false report about the incident. He was found not guilty of placing Benton in a sleeper hold that caused his death.
Schmeltz was convicted of filing a false report in the incident and violating Benton's rights for pushing him in the booking area while he was handcuffed.
Lucas County Sheriff James Telb and internal affairs Captain Ron McBroom not guilty to charges related to the incident.
Judge David Katz sentenced Gray to three years in prison and Schmeltz to a year and a day in prison. They were released on their own recognizance until notified of where to report to begin serving their sentences.
